CONTINUED MEETING OF THE FARMVILLE TOWN COUNCIL

HELD JANUARY 15, 2008

At the continued meeting of the Farmville Town Council held on Tuesday, January 15, 2008 at 4:00 pm in the Conference Room of the Town Manager’s Office, located at the Town Hall, 116 North Main Street, there present were Mayor S.C. Newman, Jr. presiding and Council members D.E. Whitus, D.L. Hunter, S.B. Thompson, C.H. Lafoon, O.S. Overton, A.D. Reid and E.I. Gordon. Also present were Town Manager, Gerald Spates and Town Planner, Cindy Morris.

REZONING REQUEST - MERIWOOD FARM PROJECT

On motion by Mrs. Thompson, seconded by Mr. Overton and with a recorded vote with Council members Whitus, Hunter, Thompson, Lafoon, Overton, Reid and Gordon voting “aye”, Council referred a rezoning request by Mr. William Park, Developer with Pinnacle Construction & Development Corporation to the Farmville Planning Commission and authorized advertisement for a Joint Public Hearing. Mr. Park is requesting the Meriwood property, which is approximately 96 acres and located at the corner of Peery Drive and Meriwood Farm Road and the St. John’s Lutheran Church property, which is approximately 2 acres and located between South Main Street and Peery Drive be rezoned from residential district R-1 to business district B-4.

Mr. Spates introduced Developer, Mr. William Park. Mr. Park spoke of his proposed plans for a retail/commercial/residential development to be located off Meriwood Farm Road and Perry Drive. The proposed project will include three twenty-four unit two and three bedroom structures, offering the community workforce affordable housing. He said the rental units would have some income restrictions – with a range of $22,000 to $30,000. He anticipates using the front and side of the property (Perry Drive) as retail space and the property located off Meriwood Farm Road near the rear of the site as the residential rental units with a mid to upper grade hotel located between the residential and retail space. He also spoke of a need for additional independent or assisted living units in the community and hoped to be able to develop the property closest to Crestview for those needs. Mr. Park said they also have the Lutheran Church under contract and plans on using that property to create a signalize access into the development, thus taking additional traffic off the Peery Drive. Mr. Park spoke of the property as being a challenge to grade and proposes creating walking trails and water features in the center section of the development. Dr. Gordon spoke of his support for development but felt the community would have concerns with density, traffic flow and what they might see as devaluing of their property. Mr. Spates said business in a B-4 zone requires a conditional use permit and Council would have the opportunity to address any of their concerns.

RESOLUTION – APPLICATION TO THE VIRGINIA TOBACCO INDEMNIFICATION AND COMMUNITY REVITALIZATION COMMISSION

On motion by Mr. Reid, seconded by Mr. Hunter and with a recorded vote with Council members Whitus, Hunter, Thompson, Lafoon, Overton, Reid and Gordon voting “aye”, Council adopted the following resolution:

RESOLUTION

IN SUPPORT OF APPLICATION TO

THE VIRGINIA TOBACCO INDEMNIFICATION

AND COMMUNITY REVITALIZATION COMMISSION

FOR SOUTHSIDE ECONOMIC DEVELOPMENT FUNDS

TO CONSTRUCT A PORTION OF HIGH BRIDGE TRAIL

IN THE TOWN OF FARMVILLE

WHEREAS, the Town of Farmville is eligible, through the Virginia Tobacco Indemnification and Community Revitalization Commission, to apply for Southside Economic Development Funds for Fiscal Year 2008.

WHEREAS, the Town of Farmville is applying for Virginia Tobacco Indemnification and Community Revitalization Commission’s Southside Economic Development Funds by the February 1, 2008 deadline for funds in the amount of $258,076 to purchase the necessary materials to construct a portion of the High Bridge Trail in the Town of Farmville. The portion of the 3.5 mile long Trail in Farmville is located both in Prince Edward and Cumberland County.

WHEREAS, this is a tourism initiative type project and qualifies as an economic development project under the Tobacco Commission eligibility criteria where the general public is the primary beneficiary.

WHEREAS, this project will attract many visitors to the area, who will eat, sleep and shop in the area.

WHEREAS, the Tobacco Commission does not require matching funds for this project type, however the percentage of leverage funds from other sources for the overall construction of this project is 50%. The Town of Farmville will be providing a dollar for dollar ($258,076) match of requested Tobacco Commission funds by providing the labor and equipment to construct a portion of the trail in the Town of Farmville.

NOW THEREFORE BE IT RESOLVED, that the construction of the scope of work identified in the Virginia Tobacco Indemnification and Community Revitalization Commission application is vital to the creation of the Hub of the High Bridge Trail State Park.

BE IT FURTHER RESOLVED, the Town of Farmville urges the Virginia Tobacco Indemnification and Community Revitalization Commission to recognize the need for the construction of the major link of the trail and to provide the necessary funding for this project as it will enhance this tobacco region area as a tourist destination and attract outside investments.

Adopted this 15th day of January, 2008 by the Farmville Town Council.

CLOSED MEETING MOTION

On motion by Mr. Whitus, seconded by Mr. Hunter and with all Council members voting “aye”, Council went into Closed Session pursuant to Section 2.2-3711.A.3 of the Code of Virginia, for the discussion or consideration of the condition, acquisition or use of real property for public purpose, or of the disposition of publicly held property.

CERTIFICATION OF CLOSED MEETING

WHEREAS, the Farmville Town Council has convened a closed meeting on this date pursuant to an affirmative recorded vote and in accordance with the provisions of The Virginia Freedom of Information Act; and

WHEREAS, Section 2.2-3712 of the Code of Virginia requires a certification by the Farmville Town Council that such closed meeting was conducted in conformity with Virginia law;

NOW, THEREFORE, BE IT RESOLVED that the Farmville Town Council hereby certified that, to the best of each member’s knowledge, only public business matters lawfully exempted from open meeting requirements by Virginia law were discussed in the closed meeting to which this certification resolution applies, and only such public business matters as were identified in the motion convening the closed meeting were heard, discussed or considered by the Farmville Town Council.

PURCHASE OF MOTTLEY/JENKINS PROPERTY

On motion by Dr. Gordon, seconded by Mr. Lafoon and with a recorded vote with Council members Whitus, Hunter, Thompson, Lafoon, Overton, Reid and Gordon voting “aye”, Council authorized the purchase of the Mottley/Jenkins property for 1.69 million dollars.

Mr. Spates described the property, saying it is 150 aces, located in Prince Edward County and includes an 1840 manor house, a lake house and 17 rental trailers, the rental units will bring in an income of $8,100 monthly. The property also includes a 34-acre spring fed lake that has a capacity of 100 million gallon water storage. The lake is 4.2 miles upstream from the Farmville Water Treatment Plant and when in need, water can be released through a siphon with gravity flow directly into the Appomattox River. Mr. Spates said the intake at the Buffalo Creek will pump directly into the water at the Appomattox River. He added that the lake water has been tested and the results came back perfect.

Mr. Spates said Town Council still views the Sandy River intake and pipeline as the ultimate solution in drought conditions and will continue to work with the County on achieving the intake and pipeline. He said he sees this purchase as being an immediate insurance policy for the Town of Farmville.

On motion by Mrs. Thompson, seconded by Mr. Lafoon the meeting was recessed at 5:30 pm.
