RECONVENED MEETING OF THE FARMVILLE TOWN COUNCIL HELD ON FRIDAY, FEBRUARY 1, 2008 At the reconvened meeting of the Farmville Town Council held at 4:30 pm on Friday, February 1, 2008 in the Conference Room of the Town Manager’s Office located at 116 North Main Street, there present were Mayor S.C. Newman, Jr. presiding and Council members D.E. Whitus, D.L. Hunter, C.H. Lafoon, A.D. Reid, and E.I. Gordon. Also in attendance were Town Manager, Gerald J. Spates and Town Attorney, Donald C. Blessing. Council member Overton entered the meeting at 5:00 pm. Mayor Newman called the meeting to order and Town Manager, Gerald Spates read the following special notice of the reconvened meeting: This is to serve notice of a reconvened Council meeting that will be held Friday, February 1, 2008 at 4:30 pm at the Town Hall, Town Manager’s Conference Room, located at 116 North Main Street, Farmville, Virginia. The purpose of this meeting is as follows: 1. Discuss and take possible action in regards to petitioning for writ of election to fill unexpired terms of At-Large Seat (Lafoon) and Ward B Seat (Thompson) and 2. To take possible action in regards to any other business that may come before Council. SPECIAL ELECTIONS On motion by Dr. Gordon, seconded by Mr. Hunter and with a recorded vote with Council members Whitus, Hunter, Reid and Gordon voting “aye”, and Council member Lafoon abstaining stating “conflict” the motion is in regards to the seat he is currently filling and Council member Overton passing, stating he arrived at the meeting late and was not present during the entire discussion, members agreed to follow the recommendations of the Board of Elections and Office of the Attorney General and proceed with the process for holding a special election to fill the remaining term of the At-Large seat vacated by Mr. Harlan Horton and the Ward B seat vacated by Mrs. Anne Nase. Members authorized the Town Attorney to proceed with filing the appropriate documents. Mr. Spates and Mr. Blessing informed members of an electronic correspondence Mr. Blessing received today from the Virginia State Board of Electors regarding Council’s recent appointments of C.H. Lafoon and S.B. Thompson for the At-Large seat vacated by Harlan Horton and the Ward B seat vacated by Anne Nase. The Board of Electors received an inquiry relating to the two appointments. The inquirer asked for an opinion as to whether Farmville Town Council has the authority to appoint members to serve out the remaining term of a Council member. The Board of Electors and Counsel for the Office of the Attorney General reviewed the Town Charter and the Code of Virginia. Based on their review, they are requesting the Town proceed immediately and ask the Court to enter nunc pro tunc order, one for each vacancy, calling for special elections to be held on Tuesday, May 6, 2008. Also noted was the deadline for candidates to file in special elections is 7:00 pm on Tuesday, March 4, 2008. Mr. Spates said the Town Charter does not say whether the filled vacancy is for the unexpired portion of the term or until a special election is held. Since the Charter does not specifically address this matter, the Code of Virginia §§24.2-226 and 24.2-228 applies. The Code states the position is filled until a special election is held. Mr. Blessing and Mr. Spates recommended Council adhere the advice of the Attorney General’s office. Members discussed their options and agreed to move forward with the Special Election process.
