SPECIAL CALLED MEETING OF THE FARMVILLE TOWN COUNCIL HELD ON NOVEMBER 16, 2007 At the special called meeting of the Farmville Town Council held at 12:30 pm in the Conference Room of the Town Manager’s Office located at 116 North Main Street, there present were Mayor S.C. Newman, Jr., presiding and Council members D.E. Whitus, D.L. Hunter, S.B. Thompson, O.S. Overton, and E.I. Gordon. Also in attendance were Town Manager, Gerald Spates, Town Attorney, Donald Blessing and newly appointed Council member C.H. Lafoon. Mr. Lafoon has not taken his oath of office and did not participate in the meeting. Mayor Newman called the meeting to order and Town Manager, Gerald Spates read the serve notice of the special Council meeting stating the purpose of the meeting was as follows: 1. To discuss Prince Edward County's proposal on the Sandy River Water project, and 2. To discuss and take possible action in regards to any other business that may come before Council Mr. Spates presented members with a copy of a letter he received from Mr. Robert Fowler, Manager of the Herberton Poplar Hill Recreation, LLLP relating to the Town connecting the temporary clubhouse at The Manor Golf Club to the town’s wastewater treatment system. Mr. Fowler’s letter states that the Town connected the clubhouse without receiving authorization from them and they were plugging the line. Mr. Spates provided members a copy of the Town of Farmville Work Order signed by John Prengaman with Poplar Hill authorizing the connection and said he had contacted the Health Department. Members discussed this matter. Mr. Spates informed guests that Council would be going into a closed session under “legal consultation”. Mr. Ken Woodley, Editor for The Farmville Herald questioned going into a closed session to discuss an issue that has been public for years and the County’s proposal was presented in public session on Thursday. Town Manager and Town Attorney said Council can consult with legal counsel in closed session. CLOSED MEETING MOTION On motion by Dr. Gordon, seconded by Mr. Hunter and with all Council members voting “aye”, Council went into a Closed Session pursuant to Section 2.2-3711.A.7 of the Code of Virginia for consultation with legal counsel and briefings by staff members, consultants or attorneys, pertaining to actual or probable litigation, or other specific legal matters requiring the provision of legal advice by counsel or staff in relationship to the Sandy River Reservoir project. CERTIFICATION OF CLOSED MEETING WHEREAS, the Farmville Town Council has convened a closed meeting on this date pursuant to an affirmative recorded vote and in accordance with the provisions of The Virginia Freedom of Information Act; and WHEREAS, Section 2.2-3712 of the Code of Virginia requires a certification by the Farmville Town Council that such closed meeting was conducted in conformity with Virginia law; NOW, THEREFORE, BE IT RESOLVED that the Farmville Town Council hereby certified that, to the best of each member’s knowledge, only public business matters lawfully exempted from open meeting requirements by Virginia law were discussed in the closed meeting to which this certification resolution applies, and only such public business matters as were identified in the motion convening the closed meeting were heard, discussed or considered by the Farmville Town Council. VOTE: 5 “AYES”, 0 “NOES” MOTION: Dr. Gordon SECOND: Mr. Whitus AYES: Whitus, Hunter, Thompson, Overton and Gordon NOES: None ABSENT DURING MEETING: Reid __________________________ Clerk On motion by Mr. Whitus, seconded by Dr. Gordon and with a recorded vote with Council members Whitus, Hunter, Thompson, Overton and Gordon voting “aye” Council thanked the Prince Edward County Board of Supervisors for their efforts yesterday at the joint Town/County meeting and said Council members have determined that the proposal of a water plant being constructed at the Sandy River Reservoir is not in the best interest of the Town of Farmville and its citizens and have directed the Town Manager to proceed with moving the water intake to the Route 45 bridge and to explore other available water opportunities.
