REGULAR WORK SESSION OF THE FARMVILLE TOWN COUNCIL

HELD ON DECEMBER 5, 2007

At the regular monthly work session of the Farmville Town Council held on December 5, 2007 at 11:00am in the Conference Room of the Town Manager’s office located at 116 North Main Street, there present were Mayor S.C. Newman, Jr. presiding and Council members D.E. Whitus, D.L. Hunter, S.B. Thompson, C.H. Lafoon, O.S. Overton, A.D Reid and E.I. Gordon. Also in attendance were Town Manager, Gerald Spates and Town Attorney, Donald Blessing.

Mayor Newman called the meeting to order and Town Manager Gerald Spates introduced Mr. Ted Cole with Davenport & Company, LLC. Mr. Cole works in the public finance division of Davenport and spoke to Council on refinancing opportunities for the Town of Farmville’s General Obligation Public Improvements Bonds, Series 2002. Mr. Cole said the 2002 Bonds were for 2.5 million dollars with a variable interest rate reset on November 1 of each year. He said when issued the rate was 2.75 percent, November of 2007 the interest rate was set at 4.15 percent. Mr. Cole spoke of the benefits of locking in the borrowing rate. Council members discussed the General Obligation Bonds of 1998 and 2002 and spoke of the potential need of additional funding to address the improvements to the Town’s infrastructure.

REFINANCING GENERAL OBLIGATION BONDS AND ADDITIONAL FUNDING

On motion by Mr. Whitus, seconded by Mrs. Thompson and with a recorded vote with Council members Whitus, Hunter, Thompson, Lafoon, Overton, Reid, and Gordon voting “aye” Council authorized Davenport & Company, LLC to draft and distribute an RFP on the Town of Farmville’s behalf to secure a fixed interest rate on the refinancing of the Town’s Series 1998 and Series 2002 General Obligation Bonds and to secure additional funding needed for infrastructure improvements (amount to be determined by Town Manager). The proposal will state that the Town is interested on securing a General Obligation Bond with fixed long-term funding (15-20 years).

PROPOSED ZONING AMENDMENTS – RESIDENTIAL DISTRICT R4

On motion by Mr. Whitus, seconded by Mrs. Thompson and with all Council members voting “aye”, Council removed the request for amendments to the Town’s residential district R4 zone. Members agreed to address this at a later date.

HOLIDAY, JANUARY 2, 2008

On amended motion by Mr. Whitus, seconded by Mr. Hunter and with a recorded vote with Council members Whitus, Hunter, Thompson, Lafoon, Overton, Reid and Gordon voting “aye”, Council agreed to follow the State in granting Wednesday, January 2, 2008 as an employee holiday and rescheduled the January 2, 2008 regular work session to 11:00 am on Wednesday, January 9, 2008.

REQUEST TO PURCHASE VEHICLE

On motion by Mr. Hunter, seconded by Dr. Gordon and with a recorded vote with Council members Whitus, Hunter, Thompson, Lafoon, Overton, Reid and Gordon voting “aye”, Council authorized the purchase of a 2007 Chevy Impala from Davis Pontiac for $15,000. The vehicle will be assigned to the Farmville Police Department. $10,000 of the requested funds will be paid from the drug fund.

The vehicle has approximately 25,000 miles and the remainder of a 100,000 mile warranty. It will be replacing a 1997 Crown Victoria with over 120,000 miles and a slipping transmission.

REQUEST FOR REZONING – MRS. SHERRY HONEYCUTT

On motion by Dr. Gordon, seconded by Mr. Overton and with all Council members voting “aye”, Council referred a rezoning request on behalf of Mrs. Sherry Honeycutt to the Farmville Planning Commission and authorized advertisement for a Public Hearing. Mrs. Honeycutt is requesting her property at 1206 Milnwood be rezoned from residential district R1 to business district B4.

Town Attorney, Donald Blessing recommended Mrs. Honeycutt submit an application in the listed name of the property, Sandbox Property, LLC.

Members continued to discuss the remaining items on the agenda and no formal action was taken.

CLOSED MEETING MOTION

On motion by Mr. Whitus, seconded by Mr. Hunter and with all Council members voting “aye”, Council went into a Closed Session pursuant to Section 2.2-3711.A.7 of the Code of Virginia for consultation with legal counsel and briefings by staff members, consultants or attorneys, pertaining to actual or probable litigation, or other specific legal matters requiring the provision of legal advice by counsel or staff.

CERTIFICATION OF CLOSED MEETING

WHEREAS, the Farmville Town Council has convened an closed meeting on this date pursuant to an affirmative recorded vote and in accordance with the provisions of The Virginia Freedom of Information Act; and

WHEREAS, Section 2.2-3712 of the Code of Virginia requires a certification by the Farmville Town Council that such closed meeting was conducted in conformity with Virginia law;

NOW, THEREFORE, BE IT RESOLVED that the Farmville Town Council hereby certified that, to the best of each member’s knowledge, only public business matters lawfully exempted from open meeting requirements by Virginia law were discussed in the closed meeting to which this certification resolution applies, and only such public business matters as were identified in the motion convening the closed meeting were heard, discussed or considered by the Farmville Town Council.
