RECONVENED MEETING OF THE FARMVILLE TOWN COUNCIL HELD ON THURSDAY, APRIL 17, 2008 At the reconvened meeting of the Farmville Town Council held at 9:00 am on Thursday, April 17, 2008 in the Conference Room of the Town Manager’s Office located at 116 North Main Street, there present were Mayor S.C. Newman, Jr. presiding and Council members D.E. Whitus, D.L. Hunter, C.H. Lafoon, O.S. Overton, and E.I. Gordon. Also in attendance was Town Manager, Gerald J. Spates and Town Attorney, Donald C. Blessing. Mayor Newman called the meeting to order. Mr. Spates said department heads are working towards completing the proposed 2007-2008 Town budget. Mr. Spates suggested the proposed budget include a 5 % increase for all employees with an additional 2 % for employees that do not drive a town vehicle home, to help offset the rising costs of fuel. Members discussed the proposed salary and agreed that a 3% increase for all employees with an additional 2 % for employees that do not drive a town vehicle home would be more feasible. Mr. Spates said the preliminary proposed budget would be drawn up using those percentages. Members also suggested that the Town Manager contact the Virginia Municipal League for current salary ranges on positions. Once that information is received, it was recommended that this matter be referred to the Finance Committee for their recommendations to Town Council. CLOSED MEETING MOTION On motion by Dr. Gordon, seconded by Mr. Hunter and with all Council members voting “aye”, Council went in to closed session pursuant to Section 2.2-3711.A.7 of the Code of Virginia for consultation with legal counsel and briefings by staff members, consultants or attorneys, pertaining to actual or probable litigation, or legal matters regarding the water and wastewater issues between the County of Prince Edward and the Town of Farmville and other specific legal matters requiring the provision of legal advice by counsel. CERTIFICATION OF CLOSED MEETING WHEREAS, the Farmville Town Council has convened a closed meeting on this date pursuant to an affirmative recorded vote and in accordance with the provisions of The Virginia Freedom of Information Act; and WHEREAS, Section 2.2-3712 of the Code of Virginia requires a certification by the Farmville Town Council that such closed meeting was conducted in conformity with Virginia law; NOW, THEREFORE, BE IT RESOLVED that the Farmville Town Council hereby certified that, to the best of each member’s knowledge, only public business matters lawfully exempted from open meeting requirements by Virginia law were discussed in the closed meeting to which this certification resolution applies, and only such public business matters as were identified in the motion convening the closed meeting were heard, discussed or considered by the Farmville Town Council. VOTE: 5 “AYES”, 0 “NOES” MOTION: Dr. Gordon SECOND: Mr. Overton AYES: Whitus, Hunter, Lafoon, Overton and Reid NOES: None ABSENT DURING VOTE: Thompson and Reid ABSENT DURING MEETING: Thompson and Reid _____________________________ Clerk AUTHORIZATION TO RETAIN LEGAL COUNSEL On motion by Dr. Gordon, seconded by Mr. Lafoon and with a recorded vote with members Whitus, Hunter, Lafoon, Overton and Gordon voting “aye”, Council agreed to retain the law firm of Spotts and Fain. Council member Whitus disclosed a working relationship between the Woodlands, LLC (his employer) and the firm Spotts and Fain. He added that this relationship has in no way influenced his voting on this matter. The firm is to assist the Town of Farmville on special matters, as necessary. The meeting was adjourned at 9:55 am.
