REGULAR WORK SESSION OF THE FARMVILLE TOWN COUNCIL HELD ON AUGUST 6, 2008 At the regular monthly work session of the Farmville Town Council held on August 6, 2008 at 11:00 am in the Conference Room of the Town Manager’s office located at 116 North Main Street, there present were Mayor S.C. Newman, Jr., presiding and Council members D.E. Whitus, D.L. Hunter, S.B. Thompson, T.B. Pairet, O.S. Overton, A.D. Reid and E.I. Gordon. Also in attendance was Town Manager, Gerald J. Spates and Town Attorney, Donald C. Blessing. Mayor Newman called the meeting to order and Town Manager, Mr. Spates updated members on the upcoming August 13, 2008 Farmville Town Council agenda items. Members reviewed the agenda items. Mr. Spates informed Council that Mr. Reid knows of an ex-gang member from the Bloods that speaks to communities on the adverse affects of joining gangs. He said this person is interested in coming to Farmville to share his experiences. Council members expressed support in this matter and suggested prior to moving forward with scheduling a date Mr. Spates contact the Dr. Patricia Watkins with the county schools to see if they would also be interested in having this person speak to the students in the middle and high schools. Mr. Spates gave a verbal update on Appomattox River water level and the current flow at the Water Treatment Plant. He also said that the Plant has to operate from 5:00 am – 9:00 pm and that he has changed the Operators hours to twelve-hour shifts/36 hours a week. Mr. Spates said the Town is required to have two Operators are on duty at all times and by changing the shift hours they are able to cover the operating schedule without having to hire additional staff. REQUEST RESIDENTIAL PARKING ON PARKVIEW DRIVE On motion by Mr. Hunter, seconded by Mrs. Thompson and with all Council members voting “aye”, Council approved installing residential parking only signs on one side Parkview Drive. No parking will be permitted on the other side of the street and yellow curb will be painted by the basketball court. Mr. Spates said residents of Parkview Drive have been having problems with people parking in front of their homes when visiting Parkview Gardens Apartments. APPOINTMENT TO THE FARMVILLE PLANNING COMMISSION On motion by Mr. Hunter, seconded by Mr. Reid and with a recorded vote with Council members Whitus, Hunter, Thompson, Pairet, Overton, Reid and Gordon voting “aye”, Council approved recommending the Circuit Court of Prince Edward County appoint Council member Gordon to the Farmville Planning Commission. Dr. Gordon will be replacing Council member Otto Overton as Council’s representative on the Farmville Planning Commission. Dr. Gordon’s term will run concurrent with his seat on Town Council. Mr. Overton has asked to be replaced as Council’s representative on the Farmville Planning Commission. Dr. Gordon had served on the Planning Commission prior to being appointed to Town Council and is interested in the position. RESOLUTION – DEPARTMENT OF ALCOHOLIC BEVERAGE CONTROL On motion by Mr. Reid, seconded by Mr. Hunter and with Council members Whitus, Hunter, Thompson, Pairet, Overton, Reid and Gordon voting “aye”, Council approved the following resolution: RESOLUTION BE IT RESOLVED BY THE TOWN COUNCIL FOR THE TOWN OF . FARMVILLE, FARMVILLE, VIRGINIA that Joseph S. Hricko and Christopher L. Bolt are hereby appointed by Town Council to obtain an ABC license for the Town of Farmville, Virginia and are further authorized to sign whatever documentation that is necessary in order to effectuate the acquisition of the aforesaid license. This license is being entered into so that alcoholic beverages may be sold at the Brookleigh Country Club. ___________________________ Sydnor C. Hricko, Clerk _______________________________ Date of Adoption Mr. Spates said in order to be able to continue to sell alcoholic beverages at the Brookleigh Country Club the Town has to obtain an ABC license. After speaking with ABC Agent, Mr. Steve Lindsey and the Virginia Municipal League Attorney, Mr. Tim Ailsworth it was recommended that Council adopt a resolution granting personnel from the Club authorization to obtain the license. CLOSED MEETING MOTION On motion by Dr. Gordon seconded by Mr. Hunter and with all Council members voting “aye”, Council went into closed session pursuant to Section 2.2-3711.A.1 of the Code of Virginia, for discussion or consideration of or interviews of prospective candidates for employment, assignment, appointment, promotion, performance, demotion, salaries, disciplining or resignation of specific public officers, appointees or employees of the Town of Farmville and Section 2.2-3711.A.7 of the Code of Virginia for consultation with legal counsel and briefings by staff members, consultants or attorneys, pertaining to actual or probable litigation, or legal matters regarding the Memorandum of Understanding between the County of Prince Edward and the Town of Farmville and other specific legal matters requiring the provision of legal advice by counsel. On motion by Dr. Gordon, seconded by Mr. Hunter and with all Council members voting “aye”, Council returned to the regular order of business. CERTIFICATION OF CLOSED MEETING WHEREAS, the Farmville Town Council has convened a closed meeting on this date pursuant to an affirmative recorded vote and in accordance with the provisions of The Virginia Freedom of Information Act; and WHEREAS, Section 2.2-3712 of the Code of Virginia requires a certification by the Farmville Town Council that such closed meeting was conducted in conformity with Virginia law; NOW, THEREFORE, BE IT RESOLVED that the Farmville Town Council hereby certified that, to the best of each member’s knowledge, only public business matters lawfully exempted from open meeting requirements by Virginia law were discussed in the closed meeting to which this certification resolution applies, and only such public business matters as were identified in the motion convening the closed meeting were heard, discussed or considered by the Farmville Town Council.
