Joint Public Hearing Held on

Wednesday, February 13, 2008

Planning Commission members present: Andy Andrews, Chairman, Pam Butler, Vice Chairman, Lloyd McKay and Sam Wilson, Jr.

Town Council members present: Sydnor Newman, Jr., Mayor, and Council members Whitus, Hunter, Thompson, Lafoon, Overton, Reid and Gordon

Also in attendance: Gerald Spates, Town Manager and Cindy Morris, Town Planner

Mayor Newman called the meeting to order and Mr. Spates read the following public hearing notice:

The Farmville Town Council and Planning Commission will hold a Joint Public Hearing at 5:00 p.m., on Wednesday, February 13, 2008 in the Council Chambers located on the Second Floor of the Town Hall, 116 North Main Street Farmville Virginia, for the purpose of hearing citizen comments on the following rezoning request:

Request from Sherry Honeycutt on behalf of Sandbox Property, LLC, for property located at 1206 Milnwood Road. The request is to rezone this property from R-1 to B-4 for the purpose of building townhomes. Townhomes are not an allowed use in an R-1 zone.

Request from William Park with Pinnacle Construction & Development Corporation to rezone properties owned by Joseph M. and Lucie P. Zehner and Grace Waring Putney Trust. The Zehner property is 1.972 acres and the Putney property is .785 acres. Both are located on Peery Drive. This request is to rezone both properties from R-1 to B-4 for the purpose of mixed use development which will include commercial/retail and rental residential. Mixed use development is not an allowed use in an R-1 zone.

Mayor Newman informed guests of the three (3) minute public speaking restriction.

The following individuals appeared before members of the Farmville Planning Commission and Farmville Town Council to voice their opposition to the rezoning of residential district R1 properties to business district B4.

Garland Perkins, 111 Crestview Drive

Jack Houghton, 105 Williams Street

L.D. Phaup, Jr., 1100 Milnwood Road

Sally Gilfillan, 101 Thomas Circle

Ruth Budd, 101 Crestview Drive

Gaile McBride, 206 Crestview Drive

J.P. Young, 1103 Milnwood Road

They urged Town Council and Planning Commission members to do their “due diligence” and deny the requests – mentioning the following:

· Changing property from a residential district R1 (most restrictive residential zone) to a business district B4 zone (expressed by individuals speaking at the hearing as the most intense commercial zone)

·   Adverse effect on adjacent residential community’s property values

·   Negative effect on the adjacent residential community’s quality of life – additional noise and light pollution, increase in traffic

·   Demand and supply – town has an abundance of vacant B4 property, no need to rezone property

·   Possible negative effect on town services

·   Inaccurate information supplied by developer

·   Undue favoritism to selective property owners – mentioning the Town’s recent purchase of the residential property at 305 First Avenue

Dr. Budd presented members with a petition signed by the some residents of the Crestview community. The petition labeled “Petition of Citizens Seeking from the Farmville Town Council Compliance with the Comprehensive Plan and the Implementation of Appropriate Mitigation Measures Before Considering Rezoning Requests addressed the property on Peery Drive as being depicted in the 2005 Town of Farmville Comprehensive Plan and Future Land Use Map as a residential development and urged members to take the necessary measures to protect the existing residential neighborhood. The petition included five recommendations:

1.   Permanent abandonment of existing platted alley running directly along the north border of the Crestview subdivision and development of a 100 foot deep tree barrier

2.   Permanent abandonment of all platted right of way connecting the Crestview subdivision to any commercially zoned properties

3.   Permanent abandonment and closure by means of a dead end of the existing Peery Drive directly to the south of the recently commercial Lutheran Church

4.   The development of a new main access drive extending Meriwood Farm Road directly from Peery Drive to South Main

5.   Other protective measure that might be devised to further protect the quality of life of the residents living in residential neighborhood

The following individuals spoke in support of the rezoning requests:

Preston Schatsberg, 1302 Milnwood Road - Increase town revenue

Bill Putney, 1914 Peery Drive, owner of property being considered for rezoning

There being no one else present to express his or her views, the meeting was declared adjourned.
