REGULAR MONTHLY WORK SESSION OF THE FARMVILLE TOWN COUNCIL

HELD ON JULY 2, 2008

At the regular monthly work session of the Farmville Town Council held on July 2, 2008 at 11:00 am in the Conference Room of the Town Manager's office, located on the main floor of the Town Hall at 116 North Main Street, there present were Mayor S.C. Newman, Jr., presiding and Council members D.E. Whitus, D.L. Hunter, S.B. Thompson, T.B. Pairet, O.S. Overton, A.D. Reid and E.I. Gordon. Also in attendance were Town Manager, Gerald Spates and Town Attorney, Donald C. Blessing.

Mayor Newman called the meeting to order.

Town Manager, Gerald Spates welcomed representatives from the South Central Board of Realtors Association. Members of the Association were attending the work session to voice their concerns with the enforcement of the Town ordinance regarding yard signs and directional signs. The Town has recently been picking up temporary signs illegally displayed. Mr. Kip Lafoon addressed Council. He spoke of the signs as being a very viable tool in selling houses and asked that the Association and Town form a working relationship. Mr. Lafoon asked that the Town consider an agreement whereas the realtors in the Association would be permitted to place one generic directional sign at a street corner, to be placed in a fashion out of the line of sight of the driver, the Board would share in policing the signage, open house signs would be placed in the same fashion as directional signs and would be installed and removed the same day as the open house; the use of balloons and flags will be prohibited and no signs will be placed on median strips, or placed on sign posts or trees. Mr. Spates addressed the group saying the temporary signage is in direct conflict with State Code, which prohibits any signage to be placed in the right of ways. He also pointed out that not all realtors are a member of the Association and some homeowners sell their homes without going through a realtor.

Discussions continued and alternatives were discussed – Mr. Spates mentioned the possibility of issuing a yearly permit and contacting other localities to see how they handled similar issues. Council member Thompson suggested the matter be referred to a committee for further consideration. Council member Gordon recommended no action be taken at the work session and that this issue be added to the agenda for the Wednesday, July 9, 2008 Council meeting. Members expressed their agreement.

Mr. Spates reviewed the items on the upcoming July 9 Council meeting – recommendations were made of the following items:

REZONING REQUEST – LONGWOOD REAL ESTATE FOUNDATION

Members discussed the Foundation’s request to rezone 605, 611 High Street, and 606 Chambers Street from R1A to R3A for the purpose of constructing an Alumni Office and Conference Center and also the actions taken by the Farmville Planning Commission in approving the rezoning prior to the Public Hearing. Mr. Whitus recommended separate Public Hearings be scheduled between the Farmville Planning Commission and Town Council on issues involving zoning.

MULLIGAN’S SPORTS GRILLE REQUEST TO CLOSE STREETS

Members discussed Mr. Matt Hurley’s request on behalf of Mulligan’s Sports Grille to close off High Street, from Venable Street continuing until the furthest side of the Weyanoke building for events scheduled on July 30, August 29 and September 12, 2008. Members requested Mr. Hurley attend the July 9th Council meeting to discuss his plans.

CLOSED MEETING MOTION

On motion by Dr. Gordon, seconded by Mr. Whitus and with all Council members voting “aye”, Council went in to a closed session pursuant to Section 2.2-3711.A.1 of the Code of Virginia, for discussion or consideration of or interviews of prospective candidates for employment, assignment, appointment, promotion, performance, demotion, salaries, disciplining or resignation of specific public officers, appointees or employees of the Town of Farmville and Section 2.2-3711.A.3 of the Code of Virginia, for the discussion or consideration of the condition, acquisition or use of real property for public purpose, or of the disposition of publicly held property and Section 2.2-3711.A.7 of the Code of Virginia for consultation with legal counsel and briefings by staff members, consultants or attorneys, pertaining to actual or probable litigation, or legal matters regarding the Memorandum of Understanding between the County of Prince Edward and the Town of Farmville and other specific legal matters requiring the provision of legal advice by counsel.

On motion by Dr. Gordon, seconded by Mr. Whitus and with all Council members voting ”aye”, Council returned to the regular order of business.

CERTIFICATION OF CLOSED MEETING

WHEREAS, the Farmville Town Council has convened a closed meeting on this date pursuant to an affirmative recorded vote and in accordance with the provisions of The Virginia Freedom of Information Act; and

WHEREAS, Section 2.2-3712 of the Code of Virginia requires a certification by the Farmville Town Council that such closed meeting was conducted in conformity with Virginia law;

NOW, THEREFORE, BE IT RESOLVED that the Farmville Town Council hereby certified that, to the best of each member’s knowledge, only public business matters lawfully exempted from open meeting requirements by Virginia law were discussed in the closed meeting to which this certification resolution applies, and only such public business matters as were identified in the motion convening the closed meeting were heard, discussed or considered by the Farmville Town Council.

There being no other business the meeting was adjourned 12:55 pm.
